On July 31, 2024, the Land Division of the High Court in Kampala ruled that Onesmus Amanya must be refunded sh287 million by Samuel Mayanja, the seller of a piece of land in Singo. This decision also includes interest accrued from February 14, 2013, at a rate of 10% per year until the full amount is paid.
The case centered around a land purchase agreement where Amanya had agreed to buy 200 acres of land, located at Kyantaba Estate, Singo County, Mengo. The land, valued at sh340 million, was sold to Amanya for the same amount. However, despite completing the payment process, Amanya never took possession of the land.
Justice Aisha Naluzze Batala’s ruling on July 31 directed that Amanya should be refunded the full amount he had paid, which was sh287 million. This sum includes the payments made by Amanya, which totalled sh150 million on September 30, 2012, sh100 million on November 12, 2012, and sh37 million on February 14, 2013. The remaining balance of sh53 million was not part of the refund, as it was the outstanding amount Amanya had yet to pay.
The court found that Mayanja had failed to meet his obligations under the sale agreement. Specifically, he did not subdivide and transfer the land to Amanya as agreed. Justice Batala concluded that this failure constituted a breach of the agreement, which entitled Amanya to a refund as stipulated in the contract.
In her judgment, Justice Batala noted that the funds paid by Amanya had been inactive and did not accrue any interest while held by Mayanja. Consequently, the court ordered that Amanya be refunded the amount with interest from February 14, 2013, until the total sum is fully paid.
