Driver Accused of Smuggling Prohibited Cigarettes Released on Bail

A driver facing serious charges related to the possession of prohibited goods has been granted bail. On September 25, 2024, Hussein Isabirye was released by the Anti Corruption Court in Nakasero, under the authority of Chief Magistrate Joan Aciro. The court set Isabirye’s bail at sh4 million, with his sureties bonded at sh50 million, non-cash.

The decision to grant bail came after Isabirye presented two sureties deemed substantial by the court. He is currently charged with possessing prohibited goods, which is in violation of section 200(d)(i) of the East African Community Customs Management Act. He is also facing charges for conveying prohibited goods under section 199(b) of the same act.

If convicted under section 200(d)(i), a person could face a jail term of up to five years or be fined fifty percent of the dutiable value of the goods, or potentially both. Those found guilty of conveying prohibited goods may face fines equal to the value of the items being transported.

The prosecution, represented by litigation officers Davis Thomas Lomuria and Stella Nayebere, stated that Isabirye was apprehended with 42 sacks of Bombas Supermatch cigarettes, which had a dutiable value of sh31.2 million. This incident occurred on August 19, 2024, in Dranya, Koboko District. The prosecution argued that Isabirye was aware, or should have been aware, that these goods were prohibited.

Additionally, the prosecution claims that Isabirye used his vehicle, an Isuzu Forward with the registration number UBH 123 D, to transport the cigarettes, allegedly destined for South Sudan. Isabirye has denied all charges against him.

During the court session, Lomuria informed the magistrate that investigations are still ongoing and requested more time for the state to conclude its inquiries. The case has been adjourned until October 23, 2024, for a further mention.
