The state has objected to Sarah Babirye Kityo, the former president of the Uganda Netball Federation (UNF), seeking permission to travel to the USA. Kityo, who faces allegations of fraudulent accounting related to sh186 million, filed an application through her lawyer to obtain her passport for the trip.

Chief State Attorney Nelly Asiku, representing the Office of the Director of Public Prosecutions, argued against Kityo’s travel request. Asiku contended that the reasons provided for the travel, purportedly to attend a private meeting, were not justifiable and did not benefit Uganda.

Asiku further emphasized to the court that Kityo’s travel could potentially delay the ongoing trial proceedings. She informed the court that investigations into the case had been completed, and the prosecution was prepared to present its witnesses.

Kityo’s lawyer, Joseph Luzige, countered the state’s opposition by stating that the purpose of the trip included addressing matters concerning a children’s foundation benefiting vulnerable children in Uganda. Luzige also mentioned Kityo’s intention to visit her children residing in the USA, whom she had not seen for over a year.

Asserting Kityo’s innocence, Luzige reminded the court that his client had not been proven guilty and maintained her right to livelihood and family access. He assured the court of Kityo’s commitment to return for trial proceedings, emphasizing her readiness to prove her innocence.

Magistrate Christopher Opit, presiding over the Nakasero-based Anti-Corruption Court, postponed the ruling on Kityo’s travel application until May 7.

The prosecution alleges that between December and November 2021, while at UNF, Kityo and unidentified accomplices engaged in fraudulent accounting practices regarding sh186 million provided by the National Council of Sports for the Pent Series and the African National Championship in Namibia. Kityo has pleaded not guilty to the charge.

Kityo faces one count of fraudulent false accounting under Section 23 of the Anti-Corruption Act of 2009, with potential penalties including seven years’ imprisonment, a fine of shillings 3.7 million, or both. Additionally, a conviction under the Anti-Corruption Act could result in a 10-year ban from holding public office. She is currently out on bail awaiting trial.
