Makerere University staff members, through associations such as Makerere University Academic Staff Association (MUASA), Makerere Academic Staff Association (MASA), and the National Union of Education Institutions (NUEI), have urged the University Council to withdraw the case it filed against the Staff Appeals Tribunal in the High Court. The University had taken legal action following the Tribunal’s order to reinstate Dr. Malowa Davis Ndanyi as the Director of Human Resources.
In a letter dated January 8, 2023, addressed to University Council Chairperson Lorna Magara, the staff expressed concern over the unprecedented move, stating that it casts a negative light on the corporate governance, management, and image of the University. They argued that the Staff Tribunal is a quasi-judicial organ and questioned the representation of the Tribunal in the court case, especially considering that the University Secretary, Mr. Kiranda, supported the application.
The staff raised additional concerns about the use of taxpayers’ money in funding the legal battle, given that the University Staff Tribunal is funded by the University. They emphasized that withdrawing the case would be in the best interest of the University and its stakeholders.
The case in question revolves around the termination of Dr. Malowa’s probationary contract, leading to an appeal before the Staff Tribunal. Makerere University contests the Tribunal’s authority to confirm staff appointments, asserting that its decisions were made without proper procedural rules. The Tribunal had ordered Dr. Malowa’s reinstatement with salary arrears.
This development is part of a broader conflict between Makerere University staff and the University management, particularly the University Council, concerning the functioning of the Staff Appeals Tribunal. The Tribunal was suspended in April 2023 based on the Attorney General’s advice, leading to tensions among university staff who view it as a crucial avenue for seeking redress against dismissals.
