ODM Leader Explains Why Azimio MPs Avoid Cabinet Secretary Sessions

Orange Democratic Movement (ODM) Secretary General Edwin Sifuna has clarified the reasons why Azimio MPs do not attend sessions with Cabinet Secretaries. Sifuna explained that they believe these sessions are unconstitutional. The coalition has established rules that prevent its members from participating in such sessions because there are no constitutional provisions supporting them.

Sifuna also revealed that they have filed a reference with the High Court, and they are currently waiting for a verdict that is expected to be delivered this month. This decision is aimed at fully addressing the issue.

Sifuna made this statement while responding to a concerned Kenyan who had raised questions about why most MPs from the minority side have been missing these important sessions.

Two days before Sifuna’s statement, the Senate security committee had questioned Interior and Coordination Cabinet Secretary Kithure Kindiki regarding the state of security in the country and the mission in Haiti. During this plenary session, it was evident that several Azimio legislators were absent.

However, it was later clarified that both the parliament and the senate have the authority to question the cabinet secretaries. They are obligated to appear before the respective committees of both houses occasionally to provide updates on progress and answer questions raised by the legislators.

Article 153 (3) of the Constitution permits Senate or National Assembly committees to summon Cabinet Secretaries. This article states that a Cabinet Secretary must appear before a committee of the National Assembly or the Senate when required by the committee and answer questions regarding matters for which the Cabinet Secretary is responsible.
