Australian Court Acquits Man Who Committed Rape In His Sleep

An Australian court recently acquitted a man who had been accused of raping a woman while asleep. The defendant, a 40 year old man named Timothy Malcolm Rowland, claimed that his actions were involuntary due to a condition known as sex addiction, where individuals engage in sexual behaviors while unconscious. This rare condition was central to the court’s decision to clear him of any charges.

The incident occurred on August 26, 2022, when Rowland and the woman had been drinking at a cocktail bar. The two later went to Rowland’s apartment, where they continued drinking and took a bath together. Afterward, the woman fell asleep. It was around 6 a.m. when she woke up to find Rowland having sex with her. She immediately pushed him away, jumped out of bed, and fled from the apartment.




During the trial, it was undisputed that Rowland suffered from sex addiction. The central issue for the jury, however, was whether he was truly asleep at the time of the assault. Given the lack of additional evidence to support his claim, Rowland was acquitted of the charges.




Judge John Pickering, who presided over the case, stated that individuals cannot be held accountable for crimes committed while unconscious. He emphasized that the law cannot punish people for actions over which they have no control. Furthermore, the judge remarked that the court could not create new laws on the matter and that it was not within the jury’s purview to make decisions regarding the medical diagnosis.




This case has sparked debates about the implications of rare medical conditions in criminal cases and whether the legal system is equipped to address such situations.
