(Namisindwa) – A businesswoman from Namisindwa District has been fined UGX 12 million for possessing uncustomed goods valued at over UGX 25 million. Sylvia Muduwa, 45, was convicted by the Anti-Corruption Court in Nakasero after pleading guilty to the charge.
On November 13, 2024, the court, presided over by Principal Magistrate Grade One, Christopher Opit, sentenced Muduwa after she admitted to the offence of possessing uncustomed goods, which is a violation of the East African Community Customs Management Act, 2004. The court imposed the fine of UGX 12 million, and if Muduwa fails to pay, she faces a six month jail term.
The case was presented in court by Allan Nkoyoyo, a prosecutor from Uganda Revenue Authority (URA), who outlined the facts surrounding the offence. The incident occurred on May 1, 2023, in Mbale, where Muduwa was found with Oryx Energies and Total Quartz products originating from Kenya, with a total dutiable value of UGX 25 million.
During the proceedings, Muduwa expressed remorse for her actions, admitting that she had not fulfilled her tax obligations. She requested leniency from the court, acknowledging that her conduct had been unfair and vowing to comply with regulations in the future.
In his submission, Nkoyoyo emphasized the seriousness of the crime, which he noted is becoming increasingly common in the business community. He explained that such offences lead to significant losses in government revenue and unfair competition among businesses.
“This offence is widespread among business communities. It is important that we send a message to deter others from committing similar crimes,” Nkoyoyo said.
Magistrate Opit, after considering the plea for leniency, acknowledged that Muduwa had shown remorse and did not waste the court’s time by contesting the charge. However, he reiterated the need for strict action to curb such offences.
“The convict is hereby convicted on her own plea of guilty and sentenced to a fine of UGX 12 million. In default, she will serve six months in prison,” Opit ruled.
