Kampala, Uganda – Harriet Komuhimbo, a State House Aide, is now cleared after the Director of Public Prosecutions (DPP) dropped false allegations of trespass brought against her by a Nigerian national, Augustine Onwunche Nnamdi, in Kikandwa Zone, Lungujja, Rubaga Division.

In a withdrawal form signed by DPP Justice Jane Frances Abodo, charges against Harriet Komuhimbo and two others have been discontinued.

“This is to inform the Court that the DPP has decided to discontinue proceedings against Komuhimbo Harriet, Ahabwe Reagan (No. 55459), and Magezi Norman, charged with trespass C/S 302 (a) of the Penal Code Act,” reads the withdrawal form signed by Abodo.

It is copied to the Mwanga II Court’s Resident State Attorney and the Kampala South Regional CID Officer.

Nnamdi, through his lawyers of M/S Deric Advocates and Solicitors, asked the DPP to withdraw the charges against the officials.

“Our client avers and contends that he has withdrawn interest and has no interest whatsoever in prosecuting the above-captioned subject matter. Hence, based on the above, it is our client’s prayer and request that the matter in court should be withdrawn against the accused persons. We humbly pray that the said matter be withdrawn,” reads the letter in part.

Nnamdi also formally apologized to Komuhimbo and her colleagues for falsely accusing them of trespass.

The individuals, Harriet Akiiki Komuhimbo, 39, and Reagan Ahabwe, 31, were arraigned before Mwanga II Road Court Magistrate Adams Byarugaba on Friday, November 24, 2023, and charged with trespass contrary to Section 2 of the Penal Code Act.

Last year, a court order signed by Adams Byarugaba, the Principal Grade One Magistrate, withdrew the charges.

“It is hereby ordered that the case against the three accused persons is hereby withdrawn as per the request of the DPP,” reads the court order.

Court heard from the state prosecution that the suspects, along with others at large, were arrested on November 16, 2023, after they reportedly raided Nnamdi’s home in Kikandwa Zone, Lungujja, Rubaga Division, suspecting him of dealing in smuggled goods.
