Elizabeth Holmes Receives 90-Year Ban from Federal Health Programs

Federal regulators have announced a 90-year ban on Elizabeth Holmes, the convicted fraudster and founder of Theranos, from participating in federal health programs. This effectively serves as a lifetime ban and comes in the aftermath of Holmes’s 2022 conviction for fraud and conspiracy to commit wire fraud.

Holmes, notorious for misleading investors about the capabilities of Theranos’s blood-testing technology, was initially sentenced to around 11 years in prison, with her sentence set to begin in May 2023. This prison term was later reduced by two years in July.




The Office of Inspector General (OIG) for the Department of Health and Human Services (HHS) justified the extended ban by citing several aggravating factors, including the duration of the fraudulent acts, incarceration, and the amount of restitution ordered. Typically, the statutory minimum for exclusion from federal health care programs based on convictions like Holmes’s is five years.




Holmes’s exclusion from federal health care programs means she will not be eligible to receive benefits through programs such as Medicare or Medicaid. Additionally, she will be restricted from employment with entities that receive federal health care funding, except in limited circumstances.




Ramesh “Sunny” Balwani, Theranos’s former COO and Holmes’s associate, had already received a similar 90-year exclusion from federal programs.

HHS Inspector General Christi A. Grimm emphasized the importance of accurate diagnostic testing technology for public health and expressed concern that false statements, like those made by Holmes, could endanger patients’ health and erode trust in the healthcare system.
